Waiver and Hold Harmless Agreement

In consideration of being granted the opportunity to participate in Brazilian Jiu Jitsu classes offered by Mt. Diablo Jiu Jitsu LLC (hereinafter referred to as the "Gym"), I, {name}, the undersigned participant or, if the participant is a minor, the undersigned parent(s) and/or legal guardian of the minor participant (hereinafter collectively referred to as "Participant," "I," "me," or "my"), hereby enter into this Release, Waiver of Liability, and Hold Harmless Agreement (hereinafter referred to as the "Agreement") and unequivocally agree to the following terms:
Release and Waiver of Liability:
I acknowledge that participating in Brazilian Jiu Jitsu classes involves inherent risks and hazards associated with physical activities. I fully understand and appreciate these risks and voluntarily choose to participate. In consideration for being allowed to participate in the classes, I hereby release, discharge, and hold harmless Mt. Diablo Jiu Jitsu LLC, its owners, coaches, instructors, employees, agents, and representatives (collectively referred to as the "Released Parties"), from any and all claims, demands, causes of action, liabilities, or damages, including personal injury, disability, death, property damage, or any other loss, arising out of or related to my participation in the classes, whether caused by the negligence of the Released Parties or otherwise.
Assumption of Risk:
I acknowledge that I am aware of the risks and dangers associated with participating in Brazilian Jiu Jitsu classes and voluntarily assume all risks, whether known or unknown, associated with my participation, including, but not limited to, those arising from the actions or negligence of others, equipment failure, and the risks inherent in physical activities.
Indemnity and Hold Harmless:
I agree to indemnify and hold harmless the Released Parties from and against any and all claims, actions, suits, judgments, liabilities, losses, damages, costs, and expenses (including attorney's fees) arising out of or resulting from my participation in the classes, whether caused by the negligence of the Released Parties or otherwise.
Full Understanding and Voluntary Agreement:
I have read and fully understand the terms of this Agreement, including the release of liability, assumption of risk, and indemnity provisions. I understand that by signing this Agreement, I am giving up substantial rights, and I sign it freely and voluntarily without any coercion, inducement, assurance, or guarantee being made to me.
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the state of California. I, on behalf of myself and the minor participant (if applicable), affirm that I have carefully read and fully understand the contents of this Agreement and voluntarily agree to its terms.
